To answer your question below, please see the attached letter that I gave to the city of Molalla on the evening of the city council meeting, April 22, 2015, especially the second to last paragraph. The move from minor to major could be avoided if the city manages the overall system so that influent into the plant stays at or below one million gallons a day. DEQ will not make a final determination until we work on the next renewal of the permit. The intent of the letter is for Molalla to plan ahead to be able to gather information and invest in infiltration and inflow control now. Molalla needs to provide DEQ with a renewal application at least six months prior to the expiration of the current permit and we would make the determination then if Molalla will move to major. The notes from the April 27th meeting are accurate in portraying this decision as an “if” because it has not been made yet and DEQ will not have all of the information to make the decision until the renewal application is submitted.

The classification form serves a different purpose. It is used to determine the classification 1-4 of the collection system and treatment plant. A classification of 1 is a simple system, a classification of 4 is very complex. Wastewater treatment operators and wastewater collection system operators seek certification at a level commensurate with the level of plant or collection system that they operate. So this form is used to set the correct classification (in Molalla’s case, a collection system that is a 2 and treatment system that is a 3) and that information is included in the permit. When Molalla seeks to hire a supervisory operator for the collection system, that person must be certified by DEQ at least a 2 and the supervisory operator for the treatment system must be certified by DEQ at least at the 3 level.

I am now sending to you in a separate email the records request in your Public Records request of April 27, 2015. For your reference, once the Public Records Request was entered into our system, it was given the identifier PRR_Hansen15704.

One more question: I thought that it was not an "if" that Molalla would move from "minor" to "major" per what you and Nina said at the city council meeting I attended. I thought from the list of classification that got lost and then reconstructed that there was no doubt they were already close to major when the last permit was issued. We are not ignoring the bypass to Bear Creek that happened December 21 and ended January 1. What I am saying is that the DEQ document to respond to that event requires some action by the city that we discussed and got commitments on yesterday. So I now need to incorporate that into the document.

You had told me that it was being looked into to determine what the violations might be if any.
