DEQ already has stalled for months on many of the pending (and serious) violations - when may we expect this work to be complete and a MAO in place? If there is no agreement on the terms and condition of a MAO how can DEQ justify failing to proceed on the pending and growing violations? Are you including the need for a test well program to prove whether or not the lagoons are leaking or if not what is the progress on proving whether or not groundwater is being contaminated? DEQ needs to be forthcoming with information about the progress or lack of - we have now read the months of emails and the two very different versions of the MAO's. The out of season discharges are violations of Molalla’s permit. As we are now in the process of crafting an MAO with the City, all of the violations and outstanding enforcement actions will be factored into a final MAO. This process will take some time. Because this was done to avoid overtopping the lagoons and the severe property and environmental damage that would follow, we believe this bypass does not constitute a violation of the permit, so the City will not be making a stipulated payment at this time.
