Hello Susan

Yes, the violations of the Total Suspended solids limits that occurred between December 2016 and February 2017 are violations of the permit. Those times when the discharge exceeded 10% above the permit limit are Class 2 violations and those that are less than 10% are Class 3 violations. In David Cole’s response to your questions, he included a link to our website where a copy of our enforcement guidance lives. That document is what classifies the violations as 1, 2 or 3 with 1 being highest.
