Attachments: PIR - Expense Incurred By Bearcreek Recovery Response September 21, 2015.pdf; Dear Joni and Nina, Please read the attached document for the cost Molalla incurred "defending" itself in our Clean Water Act lawsuit. Sadly, Molalla spent months racking up huge legal fees instead of immediately trying to settle. I think DEQ should note that Molalla, always struggling with insolvency, would have been better off if DEQ had strongly enforced the rules - violation letters had no effect on practices in Molalla and DEQ's constant hope that Molalla would come into compliance was pretty worthless. It should not take years of free work by citizens to document and enforce the rules that DEQ decided not to make a fuss about - like yearly I&I and failing to fine for recycled water run off events or failure to remove biosolids on a regular basis. Molalla could perhaps have been over a half a million dollars richer if DEQ was stronger at demanding compliance. I hope DEQ works much harder to make places like Molalla comply with the letter of the Clean Water Act. At least for the next 3 1/2 years our consent decree will require public disclosure of reports and will require an escrow account for violations that we can enforce. It is a shame we can't trust DEQ to do the work it is supposedly tasked to do.
