Regarding the two subjects raised in your 3/16/15 e-mail: the garden hose that you photographed and the status of the edits to the Recycled Water Plan. I spoke with Ray Jaindl (from ODA) today and this e-mail represents our joint response to your e-mail.

 

During the January 2015 meeting between ODA and DEQ, I asked ODA if they had observed a leaking water supply line at the Coleman Ranch. When my staff were at the Ranch following up on your complaint, they noticed a wet area that appeared to be coming from a supply line that provides water to the cattle. This line is not supplying recycled water to the site so it is not under DEQ's jurisdiction. From my conversation with Mr. Jaindl today, it is clear that the hose is supplying water to the cattle and from your pictures, it leaked for quite a while. But there are no specific rules under DEQ or ODA's jurisdiction that would address a leaking hose on private property. We do not have evidence of a water quality violation resulting from this leaking hose.

 

I understood from Mr. Jaindl that Mr. Coleman has installed some fencing and has communicated to ODA that he is seeking funding to install more. DEQ has communicated with the City of Molalla and, during today's phone call, with ODA, that two edits should be made to the Recycled Water Plan to address having a setback from the fence that Mr. Coleman is installing. That way, recycled water irrigation will not occur within the fenced area. I am now seeking the City of Molalla's review of the edits. I have made it clear that they will operate under and comply with the existing Recycled Water Plan until the plan is updated. I will follow up with the City this week and take the next steps in the process of scheduling a public hearing so that I can announce that date when we put the changes to the plan out for public comment.

 

I will be in touch when there is more to share on the public comment period and hearing.

In reading your notes from your January conference call, I have a concern about the water line Tiffany mentioned. See the attached photos taken on Adams Cemetery Rd on Aug.24. For several days around that date I observed and took photos of a water hose with faulty coupling in the road ditch next to the heavy use feed lot area north of the unnamed tributary of Bear Creek. After several days the coupling was fixed - apparently the water went to the cattle trough nearby. I am curious to know if either agency is aware of that hose line and what is and where it comes from? Water seemed to flow full time as the bad coupling was sending out so much water it hit the road pavement (that's how I saw it was there in the tall grass - it was spraying onto the road).

 

I have files with photos of that hose from several other days if there is any question about site or dates the water was spraying.

 

Also, what is the plan for the re-write of Molalla's waste water discharge plan for Coleman Ranch. Since no plan has been received from Coleman (the PIR documents said that was supposed to be ready in Feb.) we are now getting close to May when land discharge begins. When will we have a hearing on the Coleman Ranch discharge issues?
