Jeff, Mark and Dan,

Susan Hansen shared with us a letter from Ring Bender to Crag Law stating that violations occurred and funds had been deposited to the sewer account per the settlement agreement. The discharge monitoring reports that the city submitted to DEQ for June and July of 2017 don’t reflect the dates and exceedances in that letter. Please see the attached email between David Cole and myself for detail on what the DMRs say. We do have your August 28th letter that explains the problem recently found with the turbidity meter so we are generally aware of the issue but we don’t have detail about which days you believe exceeded and whether that exceedance led to application of something other than Class A water. We expect that the city will amend the DMRs for June and July and include an explanation of which days exceeded and if possible what quality (Class B, Class C etc.). of recycled water was produced. Please provide the updated DMRs by close of business September 8, 2017. Thank you.

Regarding the August 28th letter and draft MAO, I want to clarify if you are proposing the conference call agenda to be the results from the expert who is analyzing the plan and a discussion of next steps for MAO? If so, we could have a half hour phone with Randy Bailey, David Cole and Jeff Bachman (tentative) to hear the experts findings and discuss next steps at 11am on September 5th. You could call my desk number directly and the three of us will be on speakerphone in my office. If you wish to include other DEQ people in the call or address further topics, please let me know and I will need to find another time, likely the following week.

Yesterday you said there had not been violations by Molalla that you were aware of since the May/June class one violation discharges into the Molalla River. See attached notice that come from Molalla's attorney to BCR because of our lawsuit. Were you aware of these violations?
