Hi Susan

To change the dates that the city can discharge would first require a change to the Total Maximum Daily Load (TMDL) document for the Molalla/Pudding River and then a modification to the permit. Revision to the TMDL is not planned at this time. Whether a future revision of the TMDL could come up with an option that allows discharges at different times of year would have to be created as part of the TMDL process. TMDL development involves consultation with other agencies and a public process.

Thanks. I have one question - I saw Fisher say that the city wants to revise its discharge dates into the Molalla River that are part of their permit. I would assume that is not a path open to them or is that under discussion? Susan

Hi Tiffany, all I am seeking is info about the premature discharge issues - the emails between the city and DEQ that addressed the "need" to discharge in Oct 2016 instead of waiting till the legal Nov. 1 date and reports about the quality of water that has been prematurely discharged - has that water from the start of the premature discharge been processed to meet the river discharge standards? Hello Susan

I am working on your request and want to clarify my understanding of the request. Do you want all the discharge data and emails and letters between DEQ and Molalla only about the topic of discharge to the Molalla River prior to the Nov 1 date (so about discharging early this year) or do you want discharge data and emails/letters between DEQ and Molalla that occurred before November 1 of this year? If the latter, how far do you want to go back? After re-reading your request, I was concerned that I might be misinterpreting it. I may need to do a fee estimate and subtract the fee from your waiver so once you have clarified this for me, I will let you know if you should expect to see a waiver. If so, I’ll need you to sign it and send or scan back.
