Susan,

The information in the request filled today goes through the 27th of October (as worded in the request).

DEQ has not sent any direct feedback to the city or their legal counsel on the Richwine report at this time. The most recent version of the MAO is 8/14/2017.

The time it takes to respond public records request are not related to how the records are managed but instead are the result of some computer challenges (consequences of system upgrades) or the simple fact that I and my staff have extremely full workloads.

Please confirm the last date on info in the Sept. 27 request you are putting in the mail so Bear Creek Recovery can file for the next group of information without overlapping.

 

Did DEQ send any feedback yet to Molalla/Ring Bender regarding analysis of the Richwine report and/or are there any new versions of a MAO?

 

Again, please note that until DEQ finds a way to provide binding assurance that Molalla is being held to the provisions of its permit and the Clean Water Act, Bear Creek Recovery will file monthly - or sooner requests. I was assured last month these kinds of delays would not be happening again and this month the wait was the same as last month. Perhaps a "Molalla public records" folder is in order so you can easily provide the information about what is or is not being accomplished?

Dear DEQ,

 

The below public records requests were filed on Oct.. 27 and Oct. 30. It is now far longer than the suggested 10 working days for a response. When will we receive the requested information? Ms. Deconcini acknowledged that DEQ would expect a monthly request from BCR regarding interactions on the growing Molalla wastewater problems and that, knowing a request would be made each month, such information would be more readily available. Instead, DEQ has clearly failed to meet the "timely" records requirement again this month.

 

Also, please tell Bear Creek Recovery when DEQ will officially respond to the Richwine report - has DEQ responded or, if it has not, when will DEQ have an official response? The concerned public is appalled that that Molalla's wastewater problems have grown to the degree outlined in the Richwine report and we are also appalled that DEQ has let the problems grow to this degree without solutions.

 

Here are the outstanding requests:

 

1. Filed on Oct. 27: Attn: Tiffany Yelton-Bram: 1.Requesting ALL documents - emails, warning letters, draft MAOs, reports, notes, etc - regarding DEQ's work on Molalla's wastewater issues between Sept 28-October 27, 2017 in the possession of Tiffany Yelton Bram. 2. Requesting all DEQ staff notes - Yelton- Bram, Bachman, Deconcini or any other DEQ staff - taken during the Sept. 12 conference call regarding Molalla issues (conference call with Ring Bender on Sept 12 noted in records).

 

2. Filed on Oct 30: " Attn: Tiffany Yelton-Bram - Requesting all documents generated or received after the warning letter to City of Molalla / Dan Huff was issued regarding the construction of Stoneplace phase 3 without DEQ input. Seeking the document outlining conditions and any other documents to Molalla or from the City of Molalla regarding the warning and the conditions. Bear Creek Recovery seeks a fee waiver if any charge is associated with said request - fee waiver document is on file."
