Dan -

A lawyer by the name of Don Kelly will likely be contacting you soon. He represents Trinity Estates HOA. Apparently, there is a neighbor who is NOT part of the HOA who welded a fence shut. The fence is on an easement that the city has. It is part of an emergency access the City required the HOA to have.

The City's attorney, Chad Jacobs, thought there could be potential liability if the City just lets it go. I told Don Kelly to reach out to you to initiate a code enforcement case. I'm not sure there is anything there.... but with the easement issue there might be.

Wanted to give you a head's up that this is one we need to investigate and do it well. Apparently the homeowner who welded the fence shut has already sued the HOA on other issues.
