Just to add to Mac's email.
Anzie St. Claire from DEQ is also strongly considering seeking their own preliminary injunction. She wants a copy of ours from Spencer.
Regarding the criminal aspect, its not that it is contingent on the ALJ finding. My understanding is that they would potentially be litigating the same issue (whether they need to have a permit), and you don't want to have a negative result in one which would would affect the other case. I am going to chat with Patrick Flanagan again about that issue. I recall Anzie saying that CHTC is basically finally conceding that they at least need a "simple permit." So if that is the case, I don't understand why they wouldn't want to do it.
We also discussed that if the PD wanted to investigate a violation or a crime, it would be best to file a potential violation in municipal court so that any penalty would go to Molalla and not the County.
