Hi Matt – Do you need a dangerous buildings posting from the City or is there one that the County uses that would apply?

Subject: Request for Uninhabitable Buildings Designation -- 110 S Mathias RD -- Molalla

Matt,

Good to chat with you earlier.

We are looking to declare the structure on 110 S Mathias RD in Molalla uninhabitable due to lack of utility service. Generally, this has been a heavy nuisance property that is already under citation for violations of open storage of junk and storage of inoperable vehicles. A number of other law enforcement actions have taken place on this property since late March.

Here are the sections of Molalla Municipal Code that apply.

8.03.055 Definitions.

E. “Dangerous building or dangerous structure” is any building or structure having one or more of the conditions or defects hereinafter described provided that such condition(s) or defect(s) exist to the extent that the Building Official, City Manager or their designate(s) can reasonably believe the life, health, property or safety of the public or the building’s or structure’s occupants are endangered:
1. 23. Whenever an occupied building lacks an operational, potable water supply
2. 24. Whenever an occupied building lacks a functioning connection to public sewer or an approved and fully operational septic facilities.

Per the attached screenshots, the City sent a final bill for non-payment on February 15, 2019 and has a shutoff confirmation note on the same date. I have also attached a narrative of our code enforcement actions and a pic of the property to give a scale of the situation.

Please let me know if you need any additional information or support. Generally, we have been advised not to approach the property without a police presence.
