Hi Nicolas,

I was out inspecting streets for pavement cuts yesterday and came across what appears to be a possible encroachment into a storm detention/water quality facility. See attached. It looks like the retaining wall on the west side is constructed of railroad ties which release chemicals that would be a violation of our NPDES permit. The plans for this area will need to be reviewed to confirm encroachment.

If they have in fact constructed this facility in the pond area then it is in violation of our Public Works requirements to maintain a healthy water quality system and likely encroaches into the storage capacity of the designed volume of the detention pond. All of the improvements will need to be removed, grading restored to original design, slope seeding and erosion control will need to be installed, and the corrections will need to be maintained to the satisfaction of Public Works until the slope is stable and vegetation is restored.
