As a follow-up, in looking at our Finance records, there has only been a commercial space on the first floor and 3 apartments on the second floor. Anything above and beyond that requires land use and other approvals.

Hi Aldo,
A parking related issue at 108 E Ross Avenue has precipitated into additional concerns regarding the use of this property. The owners, Ricky and Diane Guest, appear to have improvements going in within this building related to residential tenant improvements. In discussing the parking issue with one of the tenants a few moments ago, I found out that there are several apartment units in the second floor and there is only one access in and out for the second floor tenants. There is work underway for what appears to be additional two bedroom apartments. I know they have not paid SDC for additional units but this brings to question as to whether or not they have followed any of the land use, building permit, and fire/life/safety requirements for this property. The tenants do not have parking available which does not comply with our code, they have no way to get mail delivered, and during a previous fire had to be evacuated out of the second story window by PD and fire using ladders. If you do not have a land use approval in place right now or building permit then I suggest we place a stop work order on the property. Once we assess all of the violations that may be in place at this address then we need to have the property owners go thru the proper process of making this a mixed use property.
