Rachel – Gerald is correct. These types of e-mail or on-line discussions between City Councilors and/or Planning Commissioners may constitute deliberations and would be an ethics violation. Please refrain from doing so in the future.
As far as our City Attorney, Mr. Jacobs, he is a contract attorney that we rely on heavily. However, access to his services is severely restricted. For example, individual City Councilors do not have access unless direction is provided as a full Council. The Planning Commission does not have this kind of authority, period. The Charter provides guidance here.
Anything you would like to discuss regarding Staff, direction or requests should be brought to my attention as the City Manager.

Good Afternoon Gerald:
Thank you and I appreciate your input, however, out of courtesy I am responding to you. I didn’t realize your job responsibilities included parliamentarian and guiding the Planning Commission and its commissioners, which the later concerns me as it seems to be a conflict of interest and could be construed as you are steering the Planning Commission; an otherwise deemed impartial commission. As I understand the city charter, our City Attorney Chad Jacobs of Beery, Elsner & Hammond is the chief parliamentarian and ‘only’ in his absence does the administrator, our City Manager Dan Huff serve in that position, no one else, however, in the possibility there has been an ordinance revision as of this writing or prior to it…I would welcome receiving that information.
As to your concern this could be considered a public meeting, My intentions were and are to make a legitimate formal request and I want Mayor Thompson to be aware of this and that all information is not being provided on the website, an honest oversight I am sure, or to the Planning Commissioners, not to mention, the most important concern…for the benefit of the public at large being able to view it in its entirety at our Planning Commission webpage. I am about transparency and accountability to the citizens of the City of Molalla and Mayor Thompson; it builds trust, which is foundational to building excellent relationships with Molallans.
As a lawyer in the making, I look forward to City Attorney Chad Jacobs’ guiding voice and input to the Planning Commission if this is to happen. I hope Chad could provide the Planning Commissioners the ruling documents he plans to cover in said meeting if it is scheduled, of which I hope, would be at our next Planning Commission meeting on April 5th at 6:30pm or sometime in April. This would afford us the necessary time to review the documents prior to the meeting and prepare any question we may have enabling us to utilize Attorney Jacobs’ time with us most efficiently and productively, given this is a paid service.
Regarding you concern over the email I use…I use the email that has been put on the Planning Commission page. I have left (3) three messages for Sadie to call me regarding when my city email will be up on the PC webpage, but I have not heard from her. It is my understanding my non-city email would only be used temporarily that she was changing it to the city email. As of this writing it has not been done.
Finally, this is still a formal request for “Comprehensive Plan” Volumes II thru V to be posted immediately on the Planning Commission webpage and access provided to ‘all’ Planning Commissioners, City Council and stakeholders. Thank you!
In closing, Gerald, regarding your new position as Public Works Director that you are now serving in …I as a Molallan, want to take the time to thank you in advance for your commitment and dedication to do right by the City of Molalla, her greater Molalla community of citizens at large and for serving with our Mayor Jimmy Thompson! Congratulations and welcome to Molalla, OR!

Please do not CC all of the Planning Commission and the Mayor in your communications with staff. Including everyone constitutes a public meeting. Please contact Dan directly. If you need to email me or Aldo then please CC Dan. I have asked him to bring in the City Attorney to give the new commission the training that covers the do’s and don’ts of being a commissioner. I know you are new to the position and I wanted to make sure that you didn’t get yourself into an issue prior to the training. I will keep this short I know you are busy. Question for you? The Comprehensive Plan has (5) five Volumes, however, we were only provided Volume I and Volume I, which is 89 pages (the complete Comprehensive Plan is over 300 pages) and it is the only volume on the Planning Commission webpage. Is this an oversight? Please, can we have all Volumes I thru V put up on the Planning Commission webpage, for not only transparency for the residents of Molalla, but also, to make it available for the public and commissioners to read in its entirety?
