Hey Guys, I have several comments/questions on this temporary use document. I will list them then come in to discuss on Tuesday or Wednesday at your convenience. This seems very restrictive, cumbersome, and expensive for a food cart to pull into a space for a day or two.

B.1. Restricting use to C-1 will greatly limit the use. For example, if a food cart wanted to set up in the Tru-Value parking lot, they would not be allowed. I think they should be allowed in any zone other than residential. Allowed in Commercial zones only in B.2. No restrictions in C-2. Not sure if the question was brought up originally about allowing in industrial zones. My experience is that food carts are in commercial zones only. Perhaps this could be revisited when the full code comes back for temporary and permanent location of food carts?

B.2. Is there a special rate for a one day permit? We did not require this for the Celebrate Molalla event. Is there a difference between being at an event? If a business brings in food carts for a weekend that becomes an event of sorts. Events are a different category. This code covers only those carts that will be providing the service on a single day somewhere within a commercially zoned property. The only fee is the $75 business license which is good for one year.

B.5. Covered in B.11 B.5 covers the cart and B.11 covers the cart, equipment, customer service areas, etc.

B.6. Are there federal, state, or county standards? Health code and other standards that the City does not cover.

B.8. How can a food cart place temporary untilities underground? What does screened mean? Does covered mean they can cover them with tape, to hold the cord down? Why do have to be hidden ffrom view ffrom the right-of-way? Can they use a generator? The utilities can be above or below ground (i.e. electrical) but they must be screened from view of the ROW and can not present a trip or falling hazard to the public. Fairly standard safety and visually appealing requirements. Most are self-contained and have their own power supply. Use of generators can cause noise and health issues from exhaust. It would likely be reviewed at time of application.

B.12 Why do they have to comply with MMC 17-4.3? We have specific codes related to parking, garbage, lighting, fencing, and structures. If the only thing there is a mobile food cart for one day, then the other stuff will likely not be there. Its when a mobile vendor wants to come in for one day and brings all of the other stuff that creates a problem. It likely will not comply with our City standards and those “extra things” are more of a permanent nature.

B.13 Can regular maintenance and cleaning of the exterior be in a seperate section that addresses the condition of the unit? We were trying to keep this interim code as simple and compact as possible and that can be revisited when the full code comes back in for review.

C.1. Eight hours is a very short time. Would like to see that changed to 16. If an event runs from 8am-10pm (in summer especially) that is a

16 hour window. Does this preclude the semi-permanent placement of a food cart? This is not a approval for events. A food cart in an event would be covered under the event permit times and language.

C.b.ii. Why? Similar to B.12.

C.b.iv. Why will they be required to connect to a potable water tank. Quite often there is no water available. Again, I refer to CM and such events. If they set up in Clark Park or on the side of the street, there is no water available. Mobile food vendors are typically self-contained and don’t require connections to any services. This type of one day approval will be wholly contained on private property and not within a park or on the street.

D.1. Site plan and design review? Doesn't that cost $500? This is a requirement of the property owner to ensure compliance with all of our City codes. The property owner is always responsible for any activities located on their property. Apparently the Type I fee was not in the fee resolution and we will be bringing a revised Exhibit “A” to include that designation and fee and it won’t be $500. Julie is looking up comparable fees at other agencies as we speak. Good catch.
