Dear Councilors,
To avoid a public meeting issue, please do not reply all. We wanted to get this information out to you sooner than later so you had a chance to review and think of possible questions before the upcoming work session. The reason we are updating the codes is because the sewer, water, and stormwater codes are not uniform with each other and have significant gaps. In some cases, code in one utility has language regarding another utility (i.e. stormwater languages is in the sanitary sewer code and not in the stormwater code). These need to be separated and housed within their respective areas. I can explain more at the meeting if needed.
Attached are 3 proposed code updates. Chapters 13.02 and 13.12 are very short (1-2 pages). Chapter 13.08 Sewer is a significant rewrite. The old code still remains but has been reorganized, renumbered, and in some case incorporated into new sections. There were some gaps in our code that needed to be filled and we utilized and reformatted code from another agency to best fit our needs in Molalla. Please review and bring your questions to the work session next Wednesday.
We will have another work session on February 12th to review Chapter 13.13 Surface Water (AKA stormwater) and to go over any last minute items on the 3 from the meeting on the 22nd.
Please note that it is critical that we have all final code amendments ready so that they can all have first reading without edits at one meeting followed by second reading and adoption at a second meeting. Reason being is that they all have to be adopted during the same night otherwise certain codes will be eliminated and unenforceable. Below is a tentative schedule on how this will work.
Jan 22: Work Session Chapter 13.02, 13.08, 13.12
Feb 12: Work Session Chapter 13.13 and cleanup of 13.02, 13.08, and 13.12
Date TBD: Council Meeting – New Business Item – Final edits (Note: We will likely need motion or at least verbal concurrence from Council for any changes)
Date TBD: Council Meeting – Ordinance – First Reading by title only (No edits)
Date TBD: Council Meeting – Ordinance – Second Reading by title only (No edits) followed by Adoption
Last item. It is important that these changes become effective immediately at adoption through an emergency declaration because they are tied to rates and funding of the WWTP project. That is why we have the first reading at one meeting and second reading and adoption at another meeting. It provides 3 meetings and space between each meeting for concerns or questions from the community to be brought up in a timely manner. In order to get through all of these steps, it will take time and we have to have everything in place prior to the budget process and securing of funding for the WWTP. Thanks and have a good weekend.
