Mayor and Council – Just in case you hear a rumor.

You all remember that the Comprehensive Plan Amendment and Zone Change that allowed the development of the Tractor Store on 213 south of Toliver included a number of negotiated items with ODOT. One of those items that ODOT required in order to remove their appeal was a finding with regard to the Transportation Planning Rule (TPR) that secured proportionate funding for intersection improvements (Toliver and 213). This story is very long so I will not bore you with many more details but here is where we are with the Tractor Store:

  1. 1. Development Plans have been approved and permits are ready to issue by the City and County.
  2. 2. All development complies with city standards.
  3. 3. The City is not participating in any of the required frontage improvements.
  4. 4. Tractor Store has paid 100% of all applicable SDC’s – no reduction or credit was allowed.
  5. 5. Pre-construction meeting was held on March 18, 2019 with the contractor. The meeting went well, and we believe this will be a good project. Contractor indicated that he was ready to start on the 20th (today).
  6. 6. However, we do not have a development agreement signed quite yet. The agreement must meet the TPR findings and we cannot let them out the door until the agreement is signed.

 

One of the issues with a project like this one is that the developer is out of State. Oregon has different rules than some people are used to, this is not an adversarial relationship and we will get there. Bottom line – Are we holding them up? I guess the technical answer is yes, but we are following the rules, our code and the decision findings. My best guess is we will get there this week.
