Hi Lizz,

I just spent quite a bit of time with Gerald. The projects will be street, etc. This is actually a renewal of an "on-call" agreement that recently expired. Dyer has been on call and Gerald goes to them with the street projects. They did the Fenton Ave project and the Clark Park sidewalk, for example. They manage the work, hire surveyors, get the contractors, etc. They have experts at hand that we don't and staff that we don't.S

I, personally, am satisfied with his explanation and am ready to leave it in the Consent Agenda. This was done in accordance with SOPs. If we want more information up front, we will need to direct that to staff.

Hi Leota and Elizabeth,

The way the contract is set up is the same as it was with PDG. There is a general contract that is amended by Contract Modification for each project that we need done. We ask the consultant to provide us a scope of work to complete a project and then negotiate based on cost to the project. In some cases, the City will pick up some of the work to save money for the community like we did in the Clark Park Sidewalk which was under budget. As an example, I have attached Contract Modification #2 under the current contract for the Fenton Avenue project for your review. Please ignore the part where it says “Dear Name”. After the termination of the contract with PDG we were under the gun to get the contract out and finish Fenton so we didn’t lose the CDBG grant.

On page 9 and page 13 there is a breakdown showing the hourly rates of their labor costs for both engineering and land surveying. These costs are commensurate with small and medium size firms and is about 65% to 85% of that of larger firms when you compare prices.

We have completed part 1 and 2 of the Engineering portion which was supposed to total $49,800. To date we have spent $49,454.82. That was to take the work that was poorly done by PDG, fix it, verify nothing had changed, and then reissue the plans and specifications to meet the County’s needs for the federal grant. They did it in about 2 months which in my world is extraordinary. Clark Park total cost was supposed to be $28,980 and it came in at $13,446.65. The WWMP and RWUP total was supposed to be $221,000 and we are at $208,468.75 with only two meetings and some updates to both plans to go. Even with the changes created by DEQ and litigants it appears that we will still be within budget on this project.

As I read through this document, I didn't see any costs/per hour charges, etc. set out. I did see the following on page 1:

4. COMPENSATION City agrees to pay Contractor for Services rendered as identified within Scope of Work (Section 2), including reasonable costs and expenses incurred by Contractor directly related to the Services in an amount identified within a Task order or in accordance with an attached Fee schedule provided by Contractor.

In order for me to properly consider this contract, I will need to see the Scope of Work, which isn't attached. Will you please send that to me and Lizz.
