Hi Dan,

Here is the language in the code.

1.02.240 Authorization of expenditures.

A. Subject to Sections 21.D. and 22.C.3. of the City Charter, a department director or manager shall not spend or commit more than $1,000.00 of budgeted funds without approval of the City Manager.

B. Subject to Section 34.d.1. of the City of Molalla Charter, the City Manager shall receive Council approval prior to spending or committing to expenditures in excess of $10,000.00 that are outside the scope of regular daily city operations. (Ord. 2012-01 § 3; Ord. 2011-01 §1; Ord. 2007-05 §1)

Charter Chapter V ADMINISTRATIVE AUTHORITY

Section 21. Effective Date of Resolutions. Resolutions and other administrative decisions take effect on the date of adoption, or on a later date provided in the resolution. (Reso. No. 2011-10)

Chapter VIII APPOINTIVE OFFICERS

Section 34. City Manager.

(d) The manager must:

(1) Countersign all orders on the city treasury;

Sections 21.D and 22.C.3 do not exist and are an error somewhere in an older code revision. Here is my recommended language change for the code.

1.02.240 Authorization of expenditures.

A. Subject to Sections 21.D. and 22.C.3. of the City Charter, a A department director or manager shall not spend or commit more than $1,000.00 $5,000.00 of budgeted funds without approval of the City Manager.

B. Subject to Section 34.d.1. of the City of Molalla Charter, the City Manager shall receive Council approval prior to spending or committing to budgeted expenditures in excess of $10,000.00 that are outside the scope of regular daily city operations $100,000 and any expenditure over $10,000 that replaces projects or purchases identified in the approved budget.

1.02.240 (A) is in line with ORS 279C335 regarding purchases $5,000 and less. 1.02.240 (B) is in line with ORS 279C.360 – 279C.410. Feel free to modify as needed.
