Here is the situation the last I heard. It appears to be a civil situation between Mrs. White and the HOA. I will have Ronda pull reports we have generated up to this point so that you have copies.

I don’t believe many reports have been taken for this, as it’s been determined to be purely civil. Ms. White claims she has documents to show the property is to be transferred to her, the FD doesn’t acknowledge any emergency access, nor have a key, and her easement paperwork shows there was to be a “barrier” installed. At some point she did provide Brenner with a receipt for the cost of the gate she installed. Last time I spoke to her, I advised her to call her attorney regarding the reported documents she claimed to have and to follow his/her advice. She indicated she attempted to sue the association, but withdrew it at some point after she was told she needed to sue everyone in the HOA separately.

I never confirmed the documents she stated to have, nor whether the FD determined the drive to be an emergency access…I referred her to her attorney. ALL maps and the City show the driveway she paved to belong to the HOA.

Attached is a letter received today from Donald Kelly, Attorney representing Trinity Estates Homeowners Association. The letter refers to a gate attached to an easement that is on private property. My understanding is that Officer Kassab was on the scene at some point. I am going to send this to City Attorney, Chad Jacobs but I will need a statement from Officer Kassab.
