Dan,

Here are the reports that we have on file regarding the gate. As you can see, one is dated in 2016, but is regarding the same issue. City Prosecutor Amy Lindgren has been brought into this situation after we had responded to multiple incidents regarding this dispute between Mrs. White and the HOA of Trinity Ct. Estates. Each say they own and have rights to the easement and the gate that separates 803 Toliver Rd. and homes belonging to the HOA. Prosecutor Lindgren advised that she would not be prosecuting on charges of criminal mischief at the time the gate was damaged and welded shut with either party and that both parties would need to go through the appropriate civil process to determine ownership of the easement and gate. At the time, this info was brought to both parties, but each provided documentation which they feel proves ownership of the easement and gate.

I believe that Sergeant Call may have some other documentation or information that he had shared in an email this last summer. I will check with him to see what he has.

I thought there was an additional one even more recently, however I don’t see it.

I received a call from Jeana (?) Kelly this morning regarding the access gate for Trinity Estates. She asked me if we were doing anything. Can someone fill me in – I have a brain lock. I guess if we receive a letter from an attorney we need to step to it!
