Mr. Sweeney I’ve reviewed you Citizen Concern Form and associated documents (attached) regarding your property at 240 Escort St in Molalla. The City of Molalla is indeed responsible for sewer laterals in the right of way under current Municipal Code. Many of the laterals in town have “bellies” like the one you describe, which can fill with water. This comes up all the time on home inspections, but this condition is not normally cause for concern. If the toilets are flushing in the home and the sewer is flowing the City does not work on these bellies.

As for the cut on the driveway, the City of Molalla did not perform this work. Anything past the water meter toward the home would have been the work of the home owner or one of their contractors.

To try to find you more information I did some records searching. Normally plumbing work of this type would have required the plumber to pull a permit with the building official at Clackamas County in order ensure the work was done properly on the building, to protect future owners of the home such as yourself. But in reviewing records at the county I see no such permit was pulled. I also note that your home, when it was built, never had a plumbing or structural permit pulled from the County – the only permit they have on file is for electrical. However, even that electrical permit originally created on 3/7/1997 was never called in for a final inspection but was allowed to expire. It would have been the legal responsibility of the builders, plumbers and electricians who constructed the home to call for these inspections to be done. You home was built as part of the development called “Shel Mar Acres, Phase 2”. I’ve attached the entire set of As Built drawings the City has on file for that subdivision. Wilhelm Engineering Inc handled this subdivision. I’ve attached sheets 1 and 2 of the platt maps that have their information on them.
