We had a Finney's HOA meeting a while back and have some questions to get answered and are hoping that you can help.........
1. The islands on Patrol.
Can they be removed? If so, would the city help in removing them?
Reasons for this. When there is cars parked on Patrol, it is very hard for vehicles to pass by. Also, any emergency vehicles wouldn't be able to pass by if there is cars parked there. I know that Fred & Cindy Long had approached this with the city almost a year ago and the city had shared that the city was going to install NO parking signs however that hasn't been done yet. Also, could there be red paint along the street for NO Parking? The islands were part of the original land use approval and cannot be removed unless an application for removal of the islands is submitted to the Planning Department and it goes thru the planning approval process. Aldo Rodriguez, Community Planner is the best contact for the planning process and he can be reached at 503.829.6855. The width of the lanes in and out of the development is 18 feet wide which meets the old PW Standards for an 8 foot parking stall and 10 foot travel lane. A vehicle operating at the posted speed or slower will have no problem negotiating that section of roadway. The Public Works Director did look at this issue for Fred Long and determined that the travel lanes met the standards of the City. The issue was that he had difficulty negotiating backing a large travel trailer into his property at 671 Patrol Street when a vehicle was parked in front of 660 Patrol Street. My recommendation to him at that time was to coordinate with his neighbor across the street when he needed to access his property. If he was not able to resolve the issue with his neighbor then he could go to the next step of requesting No Parking signs (see process below). I did not hear back from him and considered the issue resolved between neighbors.
If the HOA would prefer to have No Parking Signs installed then all I need is to receive a letter from the HOA requesting the installation of the No Parking signs along the roadway connecting Finney’s Avenue and Cole Avenue. We will then send out a letter to the affected property owners fronting that section of roadway seeking their comments, as well as the Fire District, and then make a decision. The original plans were silent on No Parking Signs as well as the original planning file when the development was done. The easiest process is for the HOA to submit a letter to me but I want to advise you that the installation of No Parking signs along that section of roadway may put you at odds with your members that own property fronting the area in question and may increase speeds along this section because of the reasons listed above and below related to driver comfort.
2. Speed down Finney's Avenue.
Can we adjust it to be like 10 MPH? No. The minimum speed is 25 MPH for this class of roadway.
Can we install speed bumps? We recommend against the installation of speed humps because they are a hindrance to emergency services response times.
Can we install NO THRU Traffic signs at the end of Patrol and the end of Heintz? No. It is a public roadway that can be used by everyone.
Can we as homeowners make it a gated street on both ends or even just one side? No. Patrol Street and Finney’s Avenue are public right-of-way.
Reason for asking is because we have an extreme amount of traffic that drive like crazy down our street and they don't even live in our neighborhood. We have had many families move into the neighborhood in the past couple of years who have very little children. We had a child almost get hit this past summer. Most speeding thru a neighborhood like yours is done predominantly by those who live within the subdivision because they are familiar with the street and feel comfortable enough to drive faster. My recommendation would be to first send out an HOA newsletter to each property in your subdivision letting them know that you’ve received complaints about speed and to slow down in the neighborhood. There is also a misperception of actual speed versus perceived speed and someone with an untrained eye may believe that a motorist going faster than they actually are. We also encourage parents to have a talk with their kids about roadway safety and playing in the roadway with vehicles. If you do have someone driving thru the neighborhood that is not part of your neighborhood then documenting the make, model, and color of the vehicle, driver description, license plate, times of day and then submitting that information to the Police Department will help them narrow down the driver so they can make contact with them.
3. Can we mark the street with SLOW in BIG BOLD letters? No. Those signs are reserved only for specific purposes in accordance with Federal and State guidelines.
4. Can we as homeowners abolish the HOA? Over the past 8 years, we barely have anyone show up at meetings and we have to fight tooth and nail to get enought people for even a vote. The City of Molalla has no control over the HOA and it is not a City function. You may want to check with the Clackamas County Surveyors Office regarding the process to “abolish” the HOA. This process would not be through a City process.
We are planning on having another HOA meeting this coming Sunday, and I would like to have some answers from you for all of us at the meeting.
