I was out on a long vacation and just returned this morning. It appears from your email below that there are two issues that you are concerned about. One is the maintenance of Trinity Court and the second is the fire access between the cul-de-sac and Toliver Road. I will take each one separately. As I understand it, Trinity Court is under the operation and maintenance of the City of Molalla. We are currently working on the planning stages of a permanent funding mechanism for the maintenance of all streets within the City that are owned and operated by the City of Molalla. We recently performed a pavement condition study that determined there is a significant funding need for the maintenance of the streets. The current score as a whole is in the low 60’s out of a score of 100. Most agencies who have taken on street maintenance have adopted a street maintenance or street utility fee to perform crack sealing, slurry sealing, and other repairs to help maintain the health of the roadway system. Unfortunately, Molalla has not made that transition yet, but the Mayor and City Council are aware of the maintenance needs and we are working on the beginning of an information and education effort to gain support of the community to fund the maintenance of the roadways. Gas taxes no longer cover all of the needs associated with operation and maintenance of the roadway system and our backlog of work. We are currently working on repairs to potholes and trench patches around the City but will not have funds to do further pavement maintenance. Your support for street maintenance is appreciated and any support that you can convey to the Council will help further our efforts to create a street maintenance program. In regards to the fire connection at the end of Trinity Court, I have attached copies of the subdivision plat for your area for your review. If you look at file 4076-P1 you can see the area in question is described as Tract B and a note is included for this tract to see note #2. File 4076-P2 is the note page of the subdivision plat and note #2 states, “Tract “B” is created for access purposes and is subject to an emergency vehicle access easement and a private access easement for the benefit of lots 25, 16, and that portion shown as “Remainder”, and is subject to the terms and provision contained in the covenants, conditions, and restrictions, recorded as document No. 2006-100970.” Based on my research, it appears that they developer was conditioned to create a paved surface that met the fire district’s requirements and since there is no room for a turn around and the access is in place for emergency purposes and the benefit of the lots described above, the connection was made based on fire, life, and safety requirements. See attached final planning approval P33-2016. It appears from this information that the developer of the north lot has complied with this specific planning code and fire district requirement if the surface was paved to connect the lot through to the fire access that connects to the cul-de-sac on Trinity Court. Is it still our responsibility or not? We are looking at chip sealing the road before there are two many cracks and would like to know whether we can or should move ahead with this because of incorporation. Also, Brenda probably told you that I came in asking “How on earth can the City of Molalla give a homeowner permission to pave property that doesn’t belong to them and is technically not their driveway?” We have attorneys now working on this, but if you want me to fill you in on what I know call me at 503-737-9104. In the long run, I look forward to seeing this contested piece of land paved for the sake of the owners we are contesting with but there have been too many potential conflicts to let this happen without any asking of permission or even cooperative planning.
