Planner to construct a 6' tall fence to the property line on 6th Street in

the northwest corner of your property. You can proceed based on that

Mr. Fisher,

 

My name is SheriLinn Whitman, I am the home owner of 606 S Taylor Ct. I

spoke with you last year, late summer early fall, in regards to a fence I

wanted to install and how I would be impacted by the flag lots going in

behind my house. Originally I was told by Nicholas Lennartz that the fence

rules for a road intersection would also apply to the rear of my property

because of the flag driveway on the entire west side of my property. He

eventually sent me an email saying it was not the case and I was clear to

build the fence.

 

I stopped by when I was beginning to plan my fence and spoke with you as

Nicholas was no longer with the city. I bring this up to hopefully jog your

memory. My primary concern and need for the fence is because of my dog, now

dogs, a short fence will not contain them. It was imperative to me that I

knew exactly what I could do and what I couldn’t do. I had the complete

understanding from you that I could install a 6 foot high fence along the

west and north property lines. I understood the corner “line of sight”

visibility restrictions applied the east and north sides where Taylor Ct

intersects 6th street.

 

I received a code enforcement door tag today. It was issued by Brenden

(503) 759-0243 and he wrote on it that there is a code issue with my fence

the following is what was handwritten down. “New fence - 20x20 corner by

flag driveway - keep 42” or less so they can see to get in & out of

driveway. Thanks”

 

I started installing my 6 foot high fence last fall, posts are set. You

might recall when we spoke I was very concerned and upset after Nicholas

told me I had to follow the same 20x20 triangle rules as if it was a true

street intersection. This code enforcement door tag says that exact same

thing “20x20 triangle maximum height of fence 3 feet 6 inches”.

 

I am really hoping this is a misinterpretation of the code on Brenden’s

part. Will you please get back with me and let me know where I stand with

the height of my fence.
