Gerald I believe the rules would go:

  1. 1. If they are making small amounts for sale at local farmers markets as I gather is the case from the application, then they are likely not an “Industrial User” as their waste stream is essentially a “domestic source” and not regulated under section 307(b),(c), or (d) of the Clean Water Act. We can use the definitions in 40 CFR 403.3 to justify that. In which case, we have no concerns, and this email can document that finding.
  2. 2. If this is for more than just making a few bars in the kitchen for sale at a Farmers Market, then they probably are an “Industrial User”, and Soap and detergent Manufacturing is a Categorical Use #417 under the Clean Water Act… and we should discuss further.
  3. 3. In either case, Soap making takes Lye, but no discharges into the sewer outside the range of 6.0-9.0 are allowed by code, so they must neutralize with Hydrochloric Acid as appropriate.
  4. 4. Candlemaking shouldn’t produce anything but hot water unless they pour the wax directly into the drain for some reason. All forms of wax (soy, paraffin, bees wax, etc) will contribute to BOD at the plant grease buildup in the systems. It should be allowed to cool, harden, and thrown into the trash, not down the sewer.
