Wow, Sadie! That was so quick and efficient. Thank you very much for your prompt attention.

It is, however, too early to record the quitclaim deed. My client, Molalla Affordable Housing LLC (the named grantee in the quitclaim deed) is purchasing the property from the present owner. Closing is set for the week after next (May 5 or 6). Since my client does not own the property yet, we have worked out with the title company to record the quitclaim deed at closing. Would you be willing to send me the quitclaim deed and I will have it recorded at closing? The issue is that quitclaim deeds do not pass “after acquired title.” If we record it now, it is arguable that the cloud created by the Waiver of Remonstrance will not be removed since my client does not own the property yet.

Please call or email with any questions. I will be out of the office beginning Monday afternoon through the following Tuesday. If you need immediate assistance, you may talk to my legal assistant, Kate. I have copied her with this email so that you have her email address.
