I spoke with Gerald at length about this property yesterday and we looked through the PUD conditions. The PUD conditions are bizarre with regard to what would be required on the R3 properties (something like a balance of 7 units, which doesn’t come close to meeting R3 code requirements).

His take was that what Erika is proposing on the property would be denied outright because partitioning the property without design of the residual parcel would provide no guarantee that the overall balance of that land would meet R3 requirements. Any land use action would have to demonstrate that at least (~12-18 given that some of the parcel will not be buildable due to Bear Creek + Riparian bounds) units would be built in addition to all applicable public improvements. In this case at least the completion of Ona WY and frontage improvements to OR 211. There isn’t a “save it for later” land use option other than purchasing the property and keeping the existing configuration.

Is this consistent with your understanding and if so should I write a kibosh note to Erika regarding her partition plans?
