I talked to you both individually about this. I haven’t been able to track down why we enforce special setback standards in Toliver Estates. I showed you both this document. I’ve attached a scan of the sheet I was told to use to determine required setbacks for Toliver Estates. Please note the bottom “footer” on the sheet, stating that these are covenants and restrictions. I’m not familiar with the City having an obligation to uphold CCNRs. It’s typically the zoning standards we apply or, in some cases, we would apply special standards if it was developed as a Planned Unit Development or Planned Development (PUDs or PDs).

When I looked at Molalla’s code, I didn’t see any regulations relating to PUDs or PDs. However, I did see a reference to “Master Plans,” which I believe serve the same function as a PD.

I have a call in to Steve Miller to find out any background he is aware of explaining why we treat Toliver Estates differently.

I’m wondering if either of you have some background on this. Gerald said the utilities are handled differently, which led me to think this was a Master Planned development or PD from the past.

Any information you have would be helpful to me. I have three building permits stacked up awaiting my review. All three appear to not meet the Tolliver Estate special setbacks but do meet City setbacks. I need to get to the bottom of this pretty soon. I was hoping to issue one of them today, but won’t be able to if I don’t learn the background history.
