Welcome back, Gerald! We missed you. I will be out on Friday, but back on Monday. Enjoy a quiet day in the office. This summary is meant to help you as you plod through the many emails you received from me or Dan while you were gone.

Here is a quick summary of development review activities awaiting you upon your return:

  1. 1. 114 Robbins Site Design Review prior to building permits (Mr. Farner): I am writing a fairly lengthy story here because this case got me a little fired up I have attached an email string from Mr. Farner. Mr. Farner’s behavior while you were gone pushed my buttons like they haven’t been pushed in a few years. It felt like he was “patting me on my head” and only wanted to talk to you. The whole issue started with Mr. Farner dropping off a stack of papers as a Site Design Review application. When I asked him politely to fill out an application form and pay the fee. He said he had already submitted the application form and paid the fee. I didn’t see any evidence he had so I gave him a blank form to include with his plans. I also asked him about whether his plans address the Design Review conditions we placed on his development back in April. He said they did. I looked through the plans and noticed that he didn’t have any detailed civil engineering plans addressing PW Conditions of Approval. I told him he would need to include these plans with his submittal. He again said he had already submitted engineered drawings. At that point, I told him I would look through the file and get back to him but told him I didn’t want to accept plans that appeared to be incomplete, especially knowing that you would be out for a couple weeks. I didn’t want an incomplete plan-set to sit awaiting your return, only to be rejected by you about three weeks later. Right after he left the office, I looked for the “engineered plans” he claimed to have submitted. It turns out he had submitted engineered structural drawings with his original Planning Design Review application. I sent him an email right away, stating that structural engineering plans are different than civil engineering plans – again, pointing back to the conditions of approval. See below:

114 Robbins continued – Mr. Farner: A week or so passed and Mr. Farner resubmitted his plans, after filling out the Site Review form and addressing a few things I had pointed out in my cursory review of the plans at the counter. When I asked where the civil drawings were, his Office Assistant then informed me that Mr. Farner had already submitted the plans to you before you left on vacation and that you had told him everything met your requirements. I told his assistant that I would have expected you to tell me if this were the case. She then stated that Mr. Farner plans to only interact with you about engineering issues. He doesn’t want to interact with me anymore. I told his assistant that the Planning Department is the central clearinghouse for plan submittals……and that I would be the only one authorized to formally sign off on the plans on behalf of the City of Molalla before they are submitted to Clackamas County.

She said she would set up a meeting with you upon your return from vacation. In the meantime, I told her I would quickly peruse your office to see if Mr. Farner had submitted separate plans to you. I told Christie I would be checking the surface areas of your desk, table and bookcase. I didn’t find any plans from Mr. Farner – though I didn’t dig very deep in your absence.

Mr. Farner’s assistant then called Christie and set up a meeting for Wednesday, July 10th. It turns out that I will be away that day and the remainder of the week at a conference (July 10-12), so will be unable to attend the meeting with you. As a side note, Christie and Dan think you should tell Mr. Farner that he needs to submit all plans directly to me in the future. Of course, this is the way our process is supposed to work…and I was just trying to help Mr. Farner in your absence. Okay, I’m almost done being frustrated by this whole thing. Good luck. He is likely to unload on you about me. I don’t think I asked for anything out of the ordinary.

  1. 2. Dollar General: We deemed it complete and we have scheduled it for a PC hearing on August 7, 2019. I emailed the plans to you, Penunuri, and ODOT. ODOT has already completed their review. They copied you on their transmittal of the comments (look for an email on 7/2/19 from Marah Danielson). We will be looking to get comments back from you by July 17.

 

  1. 3. We rescheduled the Pre-App for the Annexation at SW corner Hwy. 213 & Hwy. 211. It has been rescheduled to Thursday, July 18 at 2:00.This worked for your schedule.

 

  1. 4. Pre-App on 7/18 at 3:00 for 118 N. Cole. This is a partition that was originally approved in 2014 but expired. Carol Malloy wants to resubmit the application. You’ll see an email from me about it.

 

  1. 5. 7/17/19 Pre-App for a Partition on the Fountain Dental/Dr. Borromeo property. Mr. Borromeo wants to first partition off the dental office but is also deep into negotiations for the narrow property to the west. You should see an email from Dan Zinder about this soon. We received the pre-app form today.

 

  1. 6. Pre-App on 7/25 for 600 W. Main (the property immediately west of BiMart). You will see an email from me about that. Sh

 

  1. 7. 7/25 HOLD for Pre-App for 723 W. Main. This is the nonconforming house that turned into a home security business without complying with any of our requirements. Now the owner, Brian Mills, wants to add firearm sales to his business. He needs an approved business license and our signature on a LUCS. I told him we wouldn’t sign off until he brings his business closer to compliance with our standards, such as a paved parking lot, and ADA-accessible parking…and receiving an access permit from ODOT. Mr. Mills hasn’t yet turned in forms or paid the fee for a pre-app, but I told him I would reserve the spot for him for now. Next week I will remind him he needs to pay the fee for his pre-app.

 

  1. 8. Tony Brooks email about school district partition near the Aquatic Center: Tony sent an email while you were away concerning the size of the storm easement you required in the conditions of approval. See his email on 6/27. The original Condition of Approval is included below:

  1. 9. Cascade Center/Ivanov Demolition Permits: Dan Zinder transmitted the Site Review applications for demolitions of all the existing structures. Look for an email dated 7/3/19. Roger Toth submitted five separate applications. Due to the potential utility issues, I wanted to await your return before we issued these.

 

  1. 10. 714 Oriental Drive (oops….Corrected to 721 Oriental Drive: New Mobile Home Site Review): This is a standard Site Review from Ty Pollman. He submitted it not long after you left on vacay, so it’s been sitting for a little while.

 

  1. 11. New Site Review: Verizon Wireless Equipment Swap on an existing tower: Zinder transmitted this today. I’m not sure if you will have comments.

 

  1. 12. 1212 Tolliver (Sawyer Truck Repair: P22-2017 Partition Extension Request): You received an email from me about this today.

 

  1. 13. Last but not least….Dr. Orr’s Partition: When I was close to finalizing the Notice of Decision, I contacted the applicant’s consultant (Kaitlin Berger from Dowl). I told her about the requirement for street frontage improvements on Hezzie and West Lane. She was prepared to push back on this. She asked if Dr. Orr could meet with you to discuss this requirement before we finalized the Notice of Decision. I told her that given the 120-day time limit, I would want to Dr. Orr to extend the 120-day time limit to allow ample time for Dr. Orr to appeal the decision if he wishes. He did submit a 30-day extension to the 120-day time-period. This gives you time to meet with him. Christie scheduled a conference call with you (and me) on July 16. You will see a detailed email from me about this issue dated June 26.
