James and Aldo,

Are we talking about the gated access on the south leg of the intersection or the west leg of the intersection? Based on views of this intersection there appears that both are paved accesses that were allowed in the past. There is also an access on Hart and 7th though I am not sure right now if the properties are connected. If truck access is needed for taxlot 52E17A00200 then it needs to be thru the access on the south leg of Section and Shaver. If 102 W 7th has an easement to cross that taxlot and use that access into Section and Shaver then that is also preferred. I don’t want to have 102 W 7th using the acces on Hart and 7th to drive down thru Hart thru the residential area but they may use 7th Street to access Molalla Ave. No special permits are required for an existing access that has been in place since before 2000. As long as there are private access easements in place, business licenses in place, and truck traffic is following what is described above then Public Works is good. Hi Aldo,

Thanks for getting back to me. I am uncertain of the need for an access permit. This is an existing entrance onto Shaver Ave/Section Street, properly gated, and used in the past. The entrance is currently a driveway - paved out to the road right of way, so I am unclear of the need for us to obtain a permit/construct a driveway for what serves as an acceptable entrance. Thanks.

Hey James,

Yes there is a concern. Do you have an access permit from the City? You would need to get an access permit from PW, in addition you needs to construct an driveway. As of now, you cannot use that access.

Hi Aldo,

We have just completed the purchase of the 7 (+-) acres that is served by this gate. Marson Trucking has an easement to use this access as well. This gate could be used by them to access their property. We may use on occasion but likely continue accessing through our current gated entry located at Shaver / Section Streets.

Was there a concern with this gate being opened?
