I spoke with Joan and here is the history. The curb and sidewalk have been that way for decades and predates the Deardorff’s purchase of the property. From the west end of the existing driveway, there used to be parking down to Metzler Avenue (about 5 spaces). Within the past 15 year or so ODOT came in and took out the parking and in its place installed a right turn pocket. It sounds as if parking was an issue for ODOT and she doesn’t remember the right turn pocket as the issue. So, it sounds as if the curbline was installed back in the day without a clear designation of the ROW boundary and likely to facilitate the ability to park vehicles in the downtown area.

Going forward, the City does not have an issue with the right turn pocket going away. Fact is that once this project gets underway with construction we will be prohibiting truck traffic on Molalla Avenue from Section Street to Heintz in accordance with our TSP. If trip generation doesn’t dictate the need for the turn pocket with the signal then my recommendation is to take out the turn pocket. You may even be able to reestablish parking on the south side of the roadway next to the gym. That would offset loss of parking in the other areas and be a win for ODOT. Just a thought.

Gary Deardorff has been easy to work with in the past and has been reasonable. He can be reached at 503-829-9140 or his wife Joan. I can give them a heads up that someone will be calling them but this needs to be addressed by ODOT and the design team since the roadway does not belong to the City. ODOT has always been thorough on securing ROW on their projects for years and I would be surprised if ODOT ROW doesn’t have an agreement somewhere in their archives. Problem is that if the document isn’t recorded at the County then there is no way to verify. That is why we record our documents. I will give Gary a call and see if he has a copy of the ROW dedication. Thanks.

Attached is the Title report for the property that our client ordered, it shows the owner as Deardorff 3-D, LLC. The secretary of state’s office says the owner of the LLC is W. Gary Deardorff, 39800 S Cooper Road (PO Box 1050), Molalla, OR 97038.

Our developer, nor the project team, has approached this owner yet to ascertain their friendliness to the project.

What support, if any, does ODOT need from our client in order to secure the quit-claim and clear up this long-standing ROW issue?

If it can’t be cleared up, can we change our design footprint to follow the lead of the City project and rebuild the ADA ramp within the ROW and not touch the driveway on OR211?

We replaced the existing ramps that did not meet ADA because we were reconstructing Molalla Avenue. Reconstruction triggered the replacement but the replacement was within the ROW. The area in question is just west of the ramp.

I have looked through all the ODOT files that I can find for the area and find no Donations nor Acquisitions in the area in question! I did find plan set from 1938 and 1985 (See attached) showing the RW being 10’ wider (40’) to the South side of the DLC and existing sidewalk as such? ODOT took over the Market Rd. from the County in approximately 1933ish. It maybe that the City or County acquired a donation for the additional 10’ between Hart Ave and Molalla Ave before ODOT took over? If no documentation can be found then I would believe that we would need to approach the current owners and ask for a QC of the additional 10’ to clear up title as it is apparent that we are occupying the area! Let me know if I can help with anything else?

Our project surveyor has done additional research, including ordering a title report for the subject property, and there is no conclusive documentation that the right turn lane, curb, sidewalk, and Fire Hydrant are actually within ODOT ROW.

It would seem that acquiring the Right-of-way for this signal improvement project would be above and beyond what is required for the condition of approval for the developer. Is there a way for ODOT to clear up the Right-of-Way by formalizing the right-turn lane? If that’s not possible, can we modify our plans to not touch the curb & driveway on OR211, and modify the curb ramps to stay within the ROW of Mollala Ave?

I have reviewed all the information and I cannot change the Right of Way from 60’ wide and 30’ on both sides. I have gone through the Legal descriptions and there is no indication that any additional right of way has been dedicated. The record two surveys that call out 43 feet on one side and one of those surveyor’s call it as 30 in another survey he filed 3 days later. The Buildings are at 42’ from centerline making them 1’ inside of a 43’ wide right of way.

The original Plat of Molalla controls the location of the Lots and the right of way. The distance is not shown on the face of the Plat and scaling it measures 60’. ODOT Map Project #R6071, Drawing Number 9B-34-20 shows a wider Right of Way line, but no information on dedication of right of way. It also show a additional lines being drawn in as a 30’ right of way and the sidewalk being outside of the that 30’ right of way.

Tony I would like you to refer this back to ODOT again to see if they might have an answer or record of dedication in this area that was not recorded. Or maybe something that I’m missing in this area.

In the mean time I’m sending a crew there to look for some additional monumentation on both right of ways.

I have looked into this and it appears that there is a discrepancy at that location related to the North line of that block. The original market rd is 60’, 30’ each side of the DLC line. But there are a series of surveys showing an extra 10’+ across the face on the South side. SEE ATTACHED. The ODOT drg shows both as possibly this was unresolved at the time and no acquisition was done to clear it up. It will be up to the Surveyor to look for a chain of title and see if they can find a deed addressing this or the lot line adjustment survey may cover the issue? An item that has popped up on this project is trying to resolve the existing right-of-way in the SW corner of the OR211 & Molalla Avenue intersection. The surveyor for the project (MultiTech Engineering) has the right-of-way line shown out in the eastbound right-turn lane in OR211, but the as-built plans for the City’s Molalla Avenue project have the right-of-way at the back of walk. ODOT’s right of way map is not clear in this regard, as it shows two lines along that segment. See attached.

Does ODOT have someone in-house who can help resolve or provide input? We feel we may be missing something, as I can’t imagine the right-turn lane and sidewalk are actually on private property. The surveyor just has not been able to find any information to the contrary.
