Tammy was able to reach out to FHWA regarding interpretation of 23CFR 645.107, based on her email below. The subject project meets the following criteria:

  1. 1. Utility infrastructure is municipally owned
  2. 2. The road is owned by the municipality
  3. 3. Federal funds were given to the municipality (municipally owned project) regardless of who delivers it

 

Therefore the project is eligible for reimbursement of the city infrastructure relocation. Please note that the utility work for this project is included in the bid contract, therefore the assumption was no additional agreement is needed.

I am not aware of any work qualifies for reimbursement and will be relocated outside of the contract, could you please confirm?.

The project in question- K18811 OR 211: OR213-S Ona Way- qualifies for this and therefore is eligible for reimbursement of the city infrastructure relocation. If the work is to be included in the bid contract, no additional agreement is needed. If any work qualifies for reimbursement and will be relocated outside of the contract, a Utility Construction Agreement will be needed. Please contact me with any questions.
