Gerald,

I will call you regarding this topic. My apologies for going back and forth on my interpretation of all the documentation surrounding this project and your infrastructure within it. Per my earlier email which Reem sent to you, I stated that three criteria needed to be met for your infrastructure to qualify for reimbursement.

  1. 1. city facility
  2. 2. 2- city project
  3. 3. 3- city road.

 

I was with the understanding that your facility was outside ODOT ROW having had prior ownership of the road before ODOT adopted it. If the city, not the county, had owned the road, this would qualify you for reimbursement. It was brought to my attention today that the county owned it before 1933. We looked through our permits to see if anything allowed us to apply it. I tried very hard to find a way to make your utility qualify for this, but I have to abide by the laws and federal interpretation of them. We will need to keep the relocation work as non-participating on the bid contract. Feel free to reach out to me to discuss.
