Dan,

I am writing to you with a concern about recently passed HB 2001 which will have a negative impact on our planning abilities for infrastructure. Section 3 subsection 5 states, “(5) When a local government makes a legislative decision to amend its comprehensive plan or land use regulations to allow middle housing in areas zoned for residential use that allow for detached single-family dwellings, the local government is not required to consider whether the amendments significantly affect an existing or planned transportation facility.” How could we not consider the impacts to transportation, sewer, water, stormwater, and parks infrastructure and master plans. We just completed our transportation and sewer master plans and this legislation basically makes them undersized and out of date. This also affects our water master plan which is under development. The legislation also classified duplexes in the same class as townhomes regardless of the size of the units and their impacts on infrastructure. I believe this was done in an effort to reduce developer and home builder contributions towards SDC and effectively relieves them from paying their fair share of SDC. This will result in a higher SDC cost to all other users to offset this legislative give away to residential developers. We will have to now change our requirements for meter sizes on these units as well as sewer sizes which will affect the tenants costs on a monthly basis. If this was an effort to get lower income families into housing then it just did the opposite and those who can afford it will now pay more on a monthly basis.

Here's my recommendation for residential zoning. Get rid of the low density residential zone and move all R-1 residential properties to R-2 and all R-2 to R-3. Since we no longer have a responsible land use law at the state level and maximizing density is the new norm, then we may as well allow for cramming in of as many bodies as possible.
