Dan,

I looked at the resolutions and ordinances for 2012, 2013, and 2014. No resolution or ordinance was passed adopting a reimbursement district.

If this came in today I would not reimburse them for roadway or stormwater improvements. The roadway improvements including a turn lane are due to the traffic generation at that location and are not considered offsite improvements. Because of the widening, they had to fill in the ditch and install storm systems. They are required, without reimbursement, to convey upstream flow thru the property so no credits for upsizing. If the Council had adopted a resolution or ordinance and went thru the public hearing process then there would be an assessment applied to the individual properties. There is not so unless they can come up with a copy of a Council passed item where property owners affected had a right to participate in the process then this request is denied.

Good afternoon Dan,

Please see the attached information for the reimbursement district that should have been set up for Stone Place Phase 1 for the street/storm improvements for HWY 211.

The first attachment is the notice of public hearing, while the 2nd attachment contains most of my pertinent city documentation that got us to the point of having a public hearing.

Aldo Rodriguez did some research a month or two back, but could not find where it was ever adopted. In researching my file for the above attachments, I found some additional documentation from Ellen Barnes that this hearing may have been held in mid - October or early November of 2009, if that helps out.

Let me know if you need any further information or have any questions from the above information.
