Karl and Jeff – I attached a highlighted summary of our Advanced Public Improvement process. Based on our research the highlighted section did not occur or Council never took official action. We cannot determine the reasons for non-action but we do know that a public hearing was not held, a resolution was not adopted and an agreement with I & E Construction was never signed. Even though we are in agreement that the application was submitted, the story just ends there. One other issue that may have turned into a problem is the fact that some of the benefitting properties were outside the city limits at the time. The City would have needed to involve Clackamas County prior to adoption in order to assess those properties. We do not believe that coordination ever took place.
