Highway 213, I have been following the City's re-zoning proposal for the
8 acre parcel south of the Toliver Road intersection on 213. After reading
the ODOT list of requirements and the minutes from the planning meeting
where your "public works manager" tries to discount what ODOT will
require in terms of safety improvements, I called ODOT's Jon Makler - he
is region one planning unit manager and can be reached at
503-731-4753. If you have not already done your own research about
what re-zoning to commercial from industrial on that site will trigger in
terms of ODOT's ability to REQUIRE safety improvements, I urge you to do
so before you rubber stamp the proposed zone change.
<br></div><div><br></div><div>Per my conversation with Mr. Makler I learned
that ODOT has repeatedly urged Fisher and Huff to postpone any binding
decisions about that site until ODOT completes a safety engineering study in
mid-August. The study will provide engineering results regarding the safety
improvements ODOT will require and associated costs. What is really
interesting is that if the 8 acre site remained zoned as industrial ODOT
would not immediately require the safety improvements the study will show.
ODOT would note the needed improvements and they could be put up for bid as
ODOT grant projects for the future - we all know it takes time for those
projects to filter through to get funded. BUT, if the city changes the
zoning as proposed to commercial it will trigger the ability of ODOT to
REQUIRE city and/or developer to fund the improvements. Have your
"managers" been clear about this ongoing ODOT interaction? ODOT
assured me that this zone change will provide them with the legal means to
require the improvements. I'd suggest you take the time to learn about
these issues, since it was clear from the planning minutes the developer had
big concerns. Why would the city rush into a zoning change that will impact
safety improvement needs BEFORE ODOT finishes the study?
<br></div><div><br></div><div>Also, in case Mayor Jimmy is still scratching
his head about why so many people from outside the city limits took the time
to attend the DEQ hearing (and even more I understand have submitted
comments) - it is because you DISPOSE OF ALL YOUR EFFLUENT AND
BIOSOLIDS OUTSIDE THE CITY LIMITS! And to Councilor Palumbo, all we can all
say is that you might want to take a minute to google and learn ALL THE
DISEASES and CONTAMINANTS that can be in "clear water". One would
have hoped by now that the city would have stopped pretending that the
effluent is clean just because it looks clear. Any grade school kid likely
could tell you that. <br></div><div><br></div><div>Good luck with ODOT - it
sounds like rough times ahead if you leap into a zone change BEFORE the ODOT
safety study is complete. Have Fisher/Huff filled you in about what ODOT is
telling them or do you just plan to trigger an ODOT action? But in
retrospect, the city is used to being in endless trouble with oversight
agencies so maybe one more agency fight is just par for the Molalla way of
