Greg – I do not have a problem waiting until the week of February 12th.

You will recall that on January 12, 2018, I sent you, as well as Adam Schultz, three (3) revised job descriptions. These positions described a Wastewater Plant Operator I, Wastewater Plant Operator II and Wastewater Plant Operator – Lead. Jason Clifford is the Lead and his job duties and responsibilities have not changed. Our Assistant Plant Operator recently resigned as I have mentioned. We created the new Wastewater Plant Operator I in order to have three (3) people at the Wastewater Plant instead of 2. Job duties are the same. Titles are more consistent with titles of the wastewater service industry.

If this creates a situation where you and your bargaining unit want to bargain then I support that process as well. However, the City’s goal here was to actually increase our staffing levels. If the bargaining unit is not in support of that process then we need to rethink our goals. I am actually confused as to the actual issue here.

Dan –

In addition to my prior message, I am also getting some concern about what may be a “new” classification at the treatment plant entitled “Operator 1”. As opposed to assistant plant operator. If you are in agreement that the timeline on this classification series is also tolled, please let me know as soon as possible.

If you are not in agreement with that, then to the extent that there are bargaining obligations under the PECBA, please consider this a demand to bargain pursuant to the statute.

In the interim, just so you know – we did not changes duties. We clarified certifications that we are already paying them for and we added the entry level person as you and I discussed.

I am leaving for southern Oregon mediation in about 2 hours. I will be south most of the week, and next week is already booked out for OTET quarterly activities.

My suggestion would be this:

We jointly agree that the notice timeline under the PECBA for mid term bargaining issues is tolled until you and I have a chance to meet and discuss. I have availability the week of February 12.

Further, to the extend the City is implementing changes in the job descriptions, I would strongly suggest you hold that activity until we have an opportunity to meet and discuss the ramifications of the changes. To proceed ahead could have consequences associated with it that neither of us would care to endure.

Let me know – I am heading south about 10:30 or so.

Greg - I have attached the memo we provided the bargaining unit. You will notice that in no way does it state “agreement from the Union”. I agree that you did not agree – that statement is coming from somewhere else.

What I can state is that you and I had discussions and that is why the word consultation was used. We discussed that the contract was silent on job descriptions. We discussed the use of the word supervisor. We discussed our need to have three people at the Waste Water Treatment Plant and that may result in additional people and wage adjustments for the Leads. I am in complete agreement that there was never a discussion of wholesale agreement from the Union and the City has never made that statement.

I am sorry for the confusion. I did keep Adam Schultz in the loop as well and he mentioned this is not coming from him. Let me know a good time to chat.

Dan –

Adam Schultz tells me that revised job descriptions/classifications have been distributed to the department in the last day or two, some or all of which contain additional or modified duties. I caveat this by saying I have not seen any of the documents. Further, Adam indicates that documents attribute agreement from the Union to the changes that are contained there in.

Prior to sending this message, I have reviewed every email communication between you and I and I can find and I do not locate any message or string of messages that would be constructed as agreement to wholesale revisions of department wide job descriptions.

Can you please provide some clarity on what is happening and what the intention of the City is?

I’ll be in southern Oregon most of next week in mediation, but will have good access to email and cell grid.
