Good morning, Dan –

I just got back from a lovely Christmas break – I hope you and your family had a happy Christmas, too.

So I’m not too troubled by the November conversation (except for a minor point – see below). But the conversation about pay concerns me, seeing how Oregon’s expanded Pay Equity Act goes into effect January 1. This would be a really good time to compare the job descriptions, actual duties, resumes and salaries paid to employees in the Public Works Department who work jobs comparable to Brenda’s (even if they are level 1 versus level 2, for example). She’s not correct that simply having a degree makes here eligible for more pay, and her comparison of her work to that of an entirely different position isn’t relevant, either. The other fact she’s missing is that she isn’t likely qualified for the Senior Accountant position, given her background and experience. But this is a really god time to establish via our own internal analysis whether Brenda receives “equal pay for comparable work”, as the law requires. I could help Chaunee with this process, if that would be beneficial.

Just an FYI: These kinds of statements trouble me:

 

By the end of the conversation, according to Gerald’s notes, he’s corrected these statements to reflect what the City’s policy states. But this brings up a new year’s resolution for employers that I’m recommending for your city: Use the new year to remind all employees via a City-wide memo or email that if they have any concerns about discrimination, retaliation or harassment, that there are multiple avenues for them to use, and then list them. The law doesn’t allow an employer to require employees to report their concerns to one person only, and even if our policies state that, the City’s ongoing interactions with Brenda make this an opportune time (from a defensive management perspective) to be on the offensive with this kind of communication. In this “metoo” era, it’s best not to take any chances.
