If Jason and the union are asking for out of class work for the meeting in Portland, then we can anticipate this kind of approach anytime we asked them to review plans or participate in master plans. If that is the case then I need to discuss with you them not participating and only be available for consultant questions regarding operation. Disappointing.

Good question. Unfortunately I’m not operating on my own initiative - these are direct orders from Dan, based on advice from the CIS attorney at that meeting. Let me know if you would like me to take any specific actions?

What work was considered out of class? A meeting with the City as an operator?

Chaunee, Mr. Clifford performed work for us yesterday that officially falls under Article 17 of the Teamster Contract (Working Out of Classification). I’ve asked him to note the hours on his timesheet. The contract states:

17.1 An Employee who is temporarily assigned out of classification shall be paid a seven (7) percent premium on his or her base wage for all hours assigned with the understanding that out of class shall not be assigned if an employee performs the higher class work for less than one half of one shift.

In other words, he’ll need a 7% premium for his shift on Wednesday the 18th. I’m not sure if you have accounting measures in place to handle this case in payroll? Please let me know what I can do in terms of workflow, to make this happen smoothly?

Mr. Huff, it looks like I misspoke about “Out of Class” work being time+1/2. It’s possible that only a 7% premium doesn’t meet your intent to compensate him properly for this work, based on our discussion. If so, let me know and I can work out the details with Gerald?

Thank you,

Andy Peters
