I’m very sorry for the confusion. I wasn’t directly quoting you, but rather paraphrasing the content of the email you sent me on Nov. 23.

Since the new letter from ODOT sent last month did make the wording clear, I took into account your sentence “if ODOT ‘requires’ the improvements then the Planning Commission has to keep those conditions in place” to mean that the PC would be moving forward with the plans for the subdivision, since they now have clear guidelines from ODOT.
By the word “plans” I meant that there will be a decision made at the next PC meeting. Since you are recommending to the PC that the improvements be made, and there is a PC meeting coming up, I believe my statement of “plans will move forward” is not incorrect in its use.
Again, I apologize for the confusion and in the future, I’ll make sure to only use statements attributed to you via direct quote and not a paraphrase. I hope this email cleared things up a bit. In no way am I trying to stir the pot or attempt to make you look bad; in fact, I thought my statement was a positive one. It means that now that we have clear guidelines from ODOT and your recommendation to the PC to make those improvements, that things will start to get under way.

Hi Conner,
I read the article in the November 30th paper. There is a section that states, “In another email conversation on November 23, Fisher said that since ODOT managers have made it clear that their instructions are requirements and not simply recommendations, plans will move forward.” I do not see that statement in my email below nor was it discussed with you over the phone.

Hi Conner,
I had a detailed discussion with Seth about the language in the original letter and he understood that if ODOT “requires” the improvements then the Planning Commission has to keep those conditions in place. There is a big difference between recommend and require. We asked ODOT to be very specific in the use of the two words so that there is no chance that their intent can be confused. City staff submitted conditions requiring the improvement be completed. The Planning Commission can override City staff and the City Council can override the Planning Commission. Based on the letter from ODOT and discussion with ODOT staff, we will recommend that the Planning Commission require the improvements to be made. The decision after that will be theirs.

Mr. Fisher,
I’m sure you’re tired of talking about this, but I took a look at the letter from Seth Brumley of ODOT that was sent on Nov. 16 that states that “the City has an obligation to require frontage improvements at the time of development.”
I know last time we were just waiting on ODOT because they sent over what were determined to be recommendations, and it seems like they went out of their way with this detailed letter to explain that they are indeed requirements.
Does that mean we can expect the Planning Commission to deny the developer’s modification request from the Oct. 5 meeting, thus ensuring the developer will build those frontage improvements?
