Hi Mark,

This is in regards to the DEQ response letter

Comment 1 – I read it to Jason. The sample was taken on Saturday with results on Sunday and they shut down the plant. They had to wait for the sample results on Sunday so there was some watering in the morning until the samples results were in and then they promptly shut down the plant and the gun. The plant and the gun was restarted on Monday and another sample taken which passed. This is the reason why there is effluent shown on the DMR report during a portion of Sunday.

Comment 2 – Clarifiers needs to be changed to Filters.

Comment 3 – Jason stated that they are barely meeting A standards but that it is bouncing on the edge. Should is probably the best word we can use at this time. Jason reiterated that we need to change the Recycled Water Use Plan to Class B. He stated he would have no problem meeting B standards. Without having a facility plan done my best estimate is that we would have to make some very expensive improvements to the plant to meet a Class A product if it is possible with our current plant technology.

Gerald and Dan:

Attached are two letters, one drafted to respond to DEQ’s Preliminary Enforcement Notice and one to provide notice of the violations and related payments to the Plaintiffs.

The response to DEQ should be sent this week, so please review and address the few questions we have ASAP. The plaintiff notification will need to be sent out as soon as we determine the exact number of violations, and how much needs to be paid into the I&I/Biosolids fund. It is already overdue, so this will also need to be accomplished quickly.
