Thanks, Dan. That eliminates the problem with DEQ, however, Paragraph 19 of the Consent Decree provides as follows:

19. As required by the NPDES Permit, the City shall treat all recycled water for the Coleman Ranch, Nursery, and Cemetery properties to the Class A treatment standard, as defined in OAR Chapter 340 Division 55. Class A treatment includes complying with the sampling frequency for Class A described in OAR Chapter 340 Division 55. During the term of this Consent Decree, as soon as the City is aware that it cannot provide Class A treatment of recycled water in any way to those properties authorized to receive such recycled water, it will cease distribution of recycled water and may not resume such distribution until the City can ensure that any recycled water distributed to such properties meets the Class A treatment standard

While distributing lower class water is not a violation in DEQ’s eyes, it could still be a violation of the Consent Decree. When do we anticipate returning to Class A?

How many days have we distributed water that wasn’t Class A? This could require a rather substantial stipulated payment into the I&I/Biosolids fund.

Mark - Gerald has been tied up with a large paving project but yes we have looked into the DMR issue and he will be sending you a letter.

First, David Cole really doesn’t know how to read the DMR

Second, we shut down the Plant when the TNTC was detected

Third, we have an e-mail from David Cole that Phil Bender was copied, that states we can continue to irrigate on Coleman Ranch with Class C water and he specifically states we would not be in in violation of the permit and do not need to stop irrigating at Coleman’s (attached).

Gerald should have time later this afternoon to get you the information.

Jason sent me the below email. If we are exceeding the NTU number, that means we’re not producing Class A water, correct? If so, each day we irrigate where we’re not meeting that standard is a violation, for which we will have to make a stipulated payment.

Can you remind me again why the turbidity is so high, and if there is anything we can do to bring it down?

Hi Mark,

I spoke with Jason this morning and the DMR was filled out correctly but David Cole apparently had trouble interpreting the information on it. The TNTC was based on a temperature issue at the plant. The crews followed protocol and shut the plant down so that no discharge issues would happen and restarted the plant and took new samples which I understand passed. This was noted in the report and there was no violation as I understand it. David just didn’t understand the information that was given to him. If you have not already received it I will ask Jason to email you a copy of the DMR sent to David Cole. Thanks.
