Dan & Gerald:
See below for some good news. DEQ will be withdrawing the penalty assessed for the “late” leak test and issuing an amended notice with penalties only for the effluent violations. Once we received the amended notice we can discuss how we want to respond to it and whether we want to do another SEP.

Just a quick note that DEQ will be issuing an amended Notice assessing a penalty only for the limit violations. No penalty for the leak test and no need for you all to file an answer to the existing notice.
