Phil and I just got off the phone with Mr. Bachmann of the Office of Compliance, and discussed briefly the issue with the leak test violation. While discussing the issues we would have with having a substantive discussion prior to the appeals deadline of 11/29, Mr. Bachmann informed us that DEQ calculates the deadline based on when the certified mail was delivered (11/16), which would push the deadline back to 12/6. We have sent an email to him to confirm in writing.
With that breathing room, we’d like to send him an email attaching the permit modification, and explaining why we believe this invalidates the fine, and have a follow up discussion on this sometime next week. Does that make sense to you two?
