Looks as though any findings of a violation by DEQ would trigger our code for a nuisance violation. However many days they were in violation could be applied.

8.05.030 Nuisances affecting public health.

A. Air Quality Violations. An Oregon Department of Environmental Quality, Air Quality Division Notice of Noncompliance that coincides with a geographic incidence patters of atypical respiratory health issues experienced by persons within a close vicinity to the property.
