Subject: FEMA RX Public Assistance COVID-19 FEMA Daily Update 6.25.2020

Good afternoon,

Another short update for today. Please keep letting us know how we can assist you, and if there are any particular topics or questions you’d like to be addressed.

Purchase of PPE Clarification: Please see the following problem statement and BLUF that will hopefully clarify some questions regarding the purchase of PPE.

Problem Statement: Is the purchase of PPE of SLTTs not directly responding to the COVID incident but mitigating the threat of the virus by providing the PPE or facemasks to staff or students eligible?

BLUF: SLTT Applicants can purchase PPE and distribute it to public and private medical care facilities and emergency service providers (ambulance, fire and police) and be reimbursed by PA at the prevailing cost share. However, an eligible Applicant could not procure PPE on behalf of a private business and be reimbursed by PA. FEMA and HHS are working together to distribute cloth facial coverings as part of a multi-prong approach to re-open American economic activity while continuing to limit spread of COVID-19 through direct federal assistance with that guidance still forthcoming. Only eligible PNP medical care facilities treating COVID-19 patients would be eligible for the reimbursement of PPE directly. Purchase of PPE is only eligible as an emergency protective measure directly related to responding to a known COVID high exposure environment, meaning, COVID is prevalent and walking into the environment is very high risk. For PNPs, emergency protective measures are generally limited to activities to prevent damage to its eligible facility. This is because emergency services are usually the legal responsibility of SLTT governments. In limited circumstances, FEMA may reimburse a PNP directly when essential components of a facility are urgently needed to save lives or protect health and safety, such as an emergency room of a PNP hospital. See PAPPG V3.1, Chapter 2:VI.B. For COVID-19 declarations, eligible PNP medical care facilities providing treatment to COVID-19 patients would be eligible to request reimbursement for medical care services including the purchase of PPE. Under the current guidance the purchase of PPE for SLTT staff and students going back to their normal walks of life is not eligible. SLTT organizations should seek CARES Act funding for any immediate shortfalls that cannot be met by FEMA until Open America Guidance is finalized.
