Subject: RX Public Assistance COVID-19 FEMA Daily Update 4.22.2020

Good afternoon and happy Earth Day!

Here’s today’s update; please keep letting us know how we can assist you.

Coronavirus Food Assistance Program (CFAP) USDA Purchase & Distribution Program: On 4/21/2020 the USDA held a webinar concerning the CFAP USDA Purchase and Distribution Program, with over 3,200 attendees. The program will be run fromAgriculture Marketing Service (AMS) HQ in DC. USDA will partner with regional and local distributors, whose workforce has been significantly impacted by the closure of many restaurants, hotels, and other food service entities, to purchase fresh produce, dairy, and meat (Chicken and Pork). There are others programs in AMS under section 32 that can be used to purchase other items, such as, frozen turkeys, frozen fruit, bison, beef, etc. This program will be partnering with 501C’s, Producers, Farmers, and distributers, processors to get the food to the Food Banks. The recording of the webinar will be available later this week. PDAT Contract Provisions Template (attached): This information came out in conjunction with the food distribution policy, but it may be helpful for other contract needs also. There are three ways to accomplish work under a federal award that are laid out in 2 C.F.R. pt. 200: (1) you do the work yourself; (2) you procure and hire a contractor to do the work; or (3) you make a subaward to an eligible subrecipient. If the state, local or tribal government wants to acquire goods and services through a food bank, this would be considered a contract pursuant to 2 C.F.R. § 200.330(c). A jurisdiction may be able to sole-source in accordance with the procurement during emergency/exigent circumstances fact sheet (attached), depending on its rules, and it must be mindful of the requirement to include all required contract provisions.

Summary of the required contract provisions:

1. Remedies

a. If above $250k- this clause would apply

2. Termination for Cause and Convenience

a. If above $10k- this clause would apply

3. EEO requirement doesn’t apply

4. Davis-Bacon requirement doesn’t apply

5. Contract work hours provision

a. If above 100k and employing mechanics or laborers this clause applies

6. Rights to inventions doesn’t apply

7. The clean air and federal water pollution act

a. If above $100k- this clause would apply

8. Debarment and suspension

a. This clause applies

9. Byrd Anti-Lobbying Amendment

a. Would apply. If above $100k- There is a certification that the contractor is required to complete.

10. Procurement of recovered materials

a. Would apply.
