Hello, Mr. Fisher –

The youth who damaged the water feature has met with his Juvenile Court Counselor and signed an agreement to pay restitution to the City of Molalla. He will be required to pay half of the requested amount (which is $2,627), while his codefendant (who is over age 18) will be required to pay the other half. The youth’s Juvenile Counselor is in contact with the codefendant’s probation officer regarding this restitution arrangement.

The youth will be participating in a program called Project Payback to earn his restitution money. Project Payback takes youth to different locations within Clackamas County to do restorative community service projects. They earn a stipend each time they participate, and all the money goes to their victim(s). This youth will be starting the program soon. Where should we mail his stipends as he earns them? Should the payments be made out to you or to the City of Molalla? Other?

The youth will also be completing an empathy-building skills group in the hopes that he’ll gain a better understanding of how his actions impacted others.

Hi Jillian,

The price for the unit came in lower and the contractor is giving the kid a break on the price to come down from Washington and install it. I am not charging him for my time to deal with this issue either, though I could. Total cost is $5,254 and we will want full reimbursement for our costs.

The rules on the sign are clear and the citizens of Molalla should not have to cover the costs for this youth who knowingly and intentionally damaged public property.

How much of the $7,500 would the City of Molalla request that this youth pay? I believe there was another young man involved – his brother who is 20 years old. Have you been contacted by anyone about his responsibility in the incident?

My name is Jillian and I’m the Victim Services Coordinator for the Clackamas County Juvenile Department. We received a report indicating that a youth was grinding his bike on a metal water feature in Fox Park, possibly causing damage. I am very sorry this happened, and the Juvenile Department is committed to holding this youth accountable in a way that is meaningful to the City of Molalla.
